February is well underway and in Tenerife a new month brings changes to travel rules, restrictions, events, laws, and other important matters that affect life here on our beautiful island. Here are some newsworthy items for February 2022 that you may find interesting.

The return of our Carnival.

Bit by bit we are seeing the annual festivals and ceremonies returning to the streets of Tenerife. It has been two years since we have been able to host our Carnival. Some cities around Spain have decided to continue to embargo this highly popular February event, but in Tenerife we can see that the dust sheets are starting to come off the floats and the groups of performers are preparing.

However, for the time being, Tenerife is still playing it safe to help prevent the spread of the Omicron variant and as a result, our famous February carnival has been postponed for the time being and now expected to take place in June.

New UK-Spain travel rules.

February 11th will mark the end of testing requirements for fully vaccinated UK-bound travellers, including the post-arrival Day 2 tests that travellers from Spain had previously been forced to pay for.

From 1st February, Spain changed its travel rules. UK tourists heading to Spain who completed their initial Covid vaccination more than 270 days prior to travel to Spain, will have to show proof of having received a booster jab to be allowed to enter the country.

Changes to travel rules and Covid certificates.

Being fully vaccinated against Covid-19 will no longer be enough for many international travellers to visit Spain from the 1st February 2022.

Spanish authorities have followed the EU’s recommendations to Member States and updated the country’s travel rules regarding Covid-19 health passes and required vaccinations. The main change is that if you completed your initial Covid-19 vaccination more than 270 days ago (around 9 months), you will need to show you have had a Covid booster shot to be able to visit Spain. EU Digital Covid Certificates which are older than 9 months will cease to be valid for travel in Spain unless they show a booster shot.

However, EU citizens, foreign residents of Spain, Spanish nationals and other categories are exempt from having to show proof of a booster shot to enter the Spanish territory, even if they were fully vaccinated more than 270 days ago.

New antigen test rule

From the 1st February, people travelling to Spain who need to take a Covid-19 test to enter the country will have to get tested within 24 hours before their arrival in the country rather than 48 hours if they choose an antigen test.

This currently affects unvaccinated travellers from EU/EEA nations as well as Spanish residents and nationals who haven’t had any Covid-19 doses, and several third-country categories relating to essential travel. Unvaccinated travellers from the majority of non-EU/EEA countries cannot visit Spain.

Changes to the wearing of face masks.

The Spanish government has decided that wearing a face mask in outdoor public spaces will no longer be compulsory and plans to approve a decree to this effect which came into force on 10th February.

However, as has been the case since summer 2020, masks still need to be worn outdoors in situations where keeping a minimum distance of two metres from the next person is difficult or impossible. The only exception is on bar and restaurant terraces.

Spain’s economy surpasses expectations.

Spain’s economy grew by 5.0 percent in 2021, showing a remarkable bounce-back from a year earlier.

This exceeded the expectations of the Bank of Spain and the OECD, which were both estimating growth of 4.5 percent and it also exceeded the expectations of the International Monetary Fund (IMF), which had expected the economy to grow by 4.6 percent.

In recent months, Spanish household spending has suffered from increasing inflation, which reached a high of 6.5 percent in December due to surging energy prices, which is being experienced by countries worldwide. According to a Spanish think tank, inflation is expected to slow slightly in 2022 but remain at a high of around 3.5 percent, while growth in the economy should accelerate to 5.6 percent, allowing for the losses of 2020 to be finally reversed.

Understanding the 90 out of 180-day rule for visiting countries in the Schengen area, including Tenerife.

British people who own a second home in Spain now have to plan their time carefully, to not break the law by overstaying the permitted limits of staying in Spain and all the other countries in the Schengen area.

Understanding the rules.

As you probably know, since the start of 2021 non-resident British owners of property in Tenerife can stay 90 days in any 180-day period within the Schengen Area, which includes Spain. The date of entry is considered as the first day of stay in the Schengen territory and the date of exit is considered as the last day of stay in the Schengen territory.

However, it is possible to leave and re-enter the Schengen Area several times during that six-month period. The 180-day reference period is not fixed, but is a moving window, on the basis of looking backwards.

That means taking a calendar and highlighting all the time you have spent in Spain and other Schengen countries during the past 180 days. If police or border officials ever question how long you’ve been in the EU, this will be how they calculate if you’ve overstayed or not.

You must understand that the Schengen rule does not work with the calendar year but is always a case of counting back 180 days.

Schengen countries are Austria, Belgium, the Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Italy, Iceland, Latvia, Liechtenstein, Lithuania, Luxemburg, Malta, the Netherlands, Norway, Poland, Portugal, Slovakia, Slovenia, Spain, Sweden and Switzerland.

Time spent in any of the above countries is taken into account, and not just your stays in Tenerife or Mainland Spain when calculating the duration of your 90-day visa-free stay.

Whatever your preferences or calculations for your time spent in Spain and other Schengen countries, once the 90 in 180 day-period is over, you will have to spend 90 days outside of the Schengen Area. An absence for an uninterrupted period of 90 days allows for a new stay for up to 90 days.

Remember that you are always counting back the last 180 days, so if you have not exhausted the 90-day limit over the past six months, you will not have to leave the Schengen Area until that is the case. When that happens, know that 90 full days outside of the Schengen Area and Spain will give you a new period of 90 days.

Planning for winter in the sun.

If you kickstart your 90 out of 180-day period during the summer in Spain, it will mean that the six-month window will end in winter, and you won’t be able to enter the Schengen Area for the next three months. For many Brits in this situation, it will mean spending the coldest, darkest and wettest months of the year back in the UK, which is often exactly what they don’t want.

In order to enjoy warmer winters in Spain and mild summers in the UK, try to avoid starting your 180-day Schengen window in summer and wait instead until at least October or November to enjoy three months of winter sunshine during the following six months.

You can split your time in Spain into several trips, so over a period of 180 days, you can spend four three-week holidays in Spain, and alternate it with three-week periods in the UK or outside the Schengen Area.

You can also break the three months you have available into six-week periods. For example, if you arrive at the beginning of November in Tenerife, spend six weeks here until the middle of December, then return to the UK to spend Christmas and New Year in the UK, then come back to Tenerife in the middle of January until the end of February. This way you will be able to spread out your time in Tenerife over a six-month period.

Overstaying your time in Spain and the rest of the Schengen area is not a good idea. There is no clear mention from Spanish government sources regarding fines, deportations or travel bans to Spain and the Schengen area for overstayers, but the likelihood of this is very high.

There are various Schengen Calculators available on the internet, to help you record your stays during past months and be able to see what period you have left to visit your property here.

More positive information comes our way via a recent report on Spanish House prices, where the Canary Islands proved to be very favourable when compared with other areas across the country.

The notaries publish official data on house prices by region, and the latest figures for August give us an idea of where prices are heading in the selected regions, as shown below.

As this chart shows, house prices are rising strongly in most regions and are up by double digits in the Canary islands, probably due to factors such as a scarcity of homes for sale, and a shift upmarket. The pandemic might also have increased interest in homes in the Canary Islands that are perceived as offering greater protection from the virus.

It is good to see that Tenerife is one of the most desirable places to purchase a property in Spain, not just for its beautiful landscape, facilities and people, but also from an investment point of view.

FOCUS ON AMARILLA GOLF

People can sometimes be forgiven for assuming that the town of Amarilla Golf in San Miguel De Abona is all fairways, greens and little white balls, but if you dig a little deeper you will soon discover there is more to this coastal town in the South of Tenerife than meets the eye. With further investment and infrastructure currently being injected into the area, from both the local authority and private investors, it is starting to feel like owning a property, or purchasing a property, in this locality is the golfing equivalent of a hole in one!

For those familiar with Amarilla Golf, you will know that the area is located directly next to the popular resort of Golf Del Sur, and access between the two towns is via 2 link roads that cross the Barranco del Saltadero.

Construction is currently taking place to add  a third  link road which will include two lanes, one in each direction, a pedestrian pathway, and a cycle lane.

The intention is to improve the accessibility between the two tourist areas and encourage the use of bicycles.

There is also hope that local transport links will now be established in Amarilla Golf as a direct result of the new link road, whereas in the past, those residing in Amarilla Golf would need to travel to Golf Del Sur to catch the bus, or the "guagua" as it is known in the Canaries.

In addition to the connection enhancements, major work has also begun on improving the promenade of Amarilla Golf.

The current rugged pathway sits between the far stretching fairways of the golf course that gaze up to the glorious national park of Mount Teide and the San Miguel Marina, which offers a fabulous location to enjoy a cool refreshment in a stylish bar, sat atop of the harbour master’s office, where one can watch the marine world go by and listen to the breeze as it tantalises the sails and masts of the armada bobbing below.

New walkways are currently in construction which, once complete, will be flourishing with plants and flowers natural to Tenerife, but most importantly the vast improvements will ensure the frontline is accessible to all, and we can enjoy the rocky coves and natural habitat that sits below, and marvel at the dramatic spray of the Atlantic Ocean coming face to face with the craggy shoreline.

The idea behind the beach is that Golf Del Sur and Amarilla Golf will soon be able to offer both residents, and guests alike, an alternative leisure activity to the communal pools that feature in all the hotels and developments in both locations. But, above all else, they will finally be able to provide a safe swimming and bathing environment in what can sometimes be a hazardous surrounding for those not familiar with this stretch of the Ocean, and the underlying power the sparkling sea can possess.

The new beach will offer a solarium, toilet facilities, showers, waste baskets and, of course, no beach would be complete without a sun bed and an umbrella.

All the aforementioned projects carry a total investment amount of three million euros, which is the largest investment made in the areas for many years, and illustrates the desire to show that there is more to this little pocket of greenery than just Golf.

It is difficult to believe we are in September, and the children are back at school and back to their now accepted "new normal life", embracing life with their usual enthusiasm. We take example from them where we can, by remaining positive, and embracing all that life has to share with us.

The reality on the island at the moment is that we are in level 3, which allows bars to stay open until 1 am, and restores some of the enjoyment of holiday life. Our beaches look healthy with numerous bodies of varying shades of brown/red displayed on the sand, buckets and spades at the ready. The boats are out, and the marine life has probably had a bit of a shock with all the recent activities.

All of this reminds us that there are many things to enjoy on the island. Favorite past times of the Team are walks in the hills and pine forests, taking in the stunning views out to sea, sipping cocktails at the beach bars, and re discovering restaurants that have re opened in and out of town.

In fact there is a general air of geniality and hospitality wherever you go. We are all just happy to be sharing our world on the islands once again. Travel between the islands has been a possibility, and some of us have managed to have a short break off the island, or a few days off to visit other parts of the island … a refreshing change and thoroughly enjoyable.

Passport stamps: What British residents in the EU need to know when crossing borders.

British nationals’ resident in the EU have become concerned in recent months as their passports have been stamped when returning home from abroad. 

Since the end of the Brexit transition period, Brits crossing EU borders have been divided into two groups; on the one hand those with the right of residency or long-stay visas and on the other hand, visitors.

For visitors, the 90-day rule comes into play, meaning that they can no longer spend more than 90 days out of every 180 in the Schengen zone, and border guards keep track of how long people have spent inside the Bloc by means of passport stamps, establishing exactly when the person entered the Schengen zone and when they left.

 But for Brits who have the right of residency in Spain – either through a visa or a residency card – things are different.

If you are a resident in Tenerife, any time that you spend here does not count to your 90-day limit (although if you were to enter France, Sweden or Italy the 90-day clock would begin ticking).

British residents should therefore not have their passport stamped when they are entering the EU country that they live in.

What should you do?

When approaching passport control going either in or out of Tenerife, you should present both your passport and proof of residency – whether this is your visa, residency card or proof that you have applied for residency.

Don’t wait to be asked for this, because at busy borders officers will just presume that anyone presenting only a passport is a tourist.

You might think you only need to present proof of residency when entering the country, but in fact you should show it when leaving as well, as passports are regularly stamped on both exit and entry.

If you are travelling within the Schengen zone it is a lot less likely that documents will be required when crossing the border, but if asked, you should present both your passport and residency document.

What if the official wants to stamp your passport?

The problem of wrongly stamped passports seems to be happening quite a lot with immigration officers at border control. The biggest issue has been persuading Border Force officials NOT to stamp a UK passport, despite the fact that a residency permit is also produced with the passport.

Some people have been unable to prevent this despite arguing with the official, so their passport has a stamp which effectively says you have only 90 days to stay in Europe. They have often been told that the rules were that every British passport should be stamped.

This is not correct, and we fully appreciate that having an argument with a border guard in another language can be a daunting task – especially as you feel the waves of frustration from everyone behind you in the queue – but if you see an error being made it is important that you point this out.

What happens if your passport is stamped in error?

This is of course the key point, but it is also where things get hazy.

It is only nine months since the transition period ended and many people have not been travelling because of the pandemic and travel restrictions, so it may be that problems are yet to reveal themselves.

The British Embassy in Germany has said: "UK nationals who were legally resident in Germany prior to the end of the transition period on December 31st 2020, and are therefore subject to the Withdrawal Agreement should not have their passports stamped when re-entering Germany". The situation is the same with Spain.

However, a stamp in your passport does not alter your rights under the Withdrawal Agreement, such as your right to reside here in Tenerife and to receive a new residence document.

Stamping a passport at the border does not mean that a decision on residence status has been taken. The stamp merely documents that the passport holder was checked in the place stated on the stamp, whether this check had been performed in the course of an entry or exit, and which means of transport was used.

The stamp entails neither the loss of rights under the Withdrawal Agreement nor in any other way a change of legal status. Consequently, a stamp on entry does not need to be annulled and may be retained unaltered in the passport as a souvenir.

If, however someone exits the Schengen area more than 90 days after their passport was stamped, then they should also carry with them a document demonstrating their current residence status, for example as a beneficiary of the Withdrawal Agreement.

The British Embassies in Spain have provided similar advice – namely that the stamp does not alter your rights of residency and incorrect stamps do not need to be annulled.

However, while a stamp may not alter your rights of residency, does having one in your passport mean you may run into problems at the border? Your residency status should be easy to prove, but it might involve delays, extra checks or even interrogations while travelling. Therefore, it is best to avoid this if you can.

The advice from all official bodies is to carry with you at all times the documentation that proves your right of residency in the EU.
